This website is operated by DragonFish Communications, Inc. ("DragonFish," "we," "us"). By checking the agreement box on our qualify form or pricing calculator, or by otherwise using this site, you agree to these terms and our Privacy Policy. If you don't agree, please don't use the site.

This site is informational: it describes DragonFish's warm and cold email services, pricing, and process, and lets you self-check whether your business is a fit before requesting contact. It is not itself the service agreement for any paid engagement.

The pricing calculator produces estimates based on the numbers you enter and our standard pricing schedule at the time you use it. Figures shown are illustrative planning examples, not guarantees of results, revenue, or return on spend. Actual outcomes depend on your list, offer, market, and execution.

Submitting the qualify form does not create a contract or a guarantee of service. DragonFish reviews submissions and reserves the right to decline any engagement, including cases where our own numbers simulation doesn't project a reasonable return.

If you move forward with a warm email, cold email, or à la carte engagement, that work is governed by a separate written agreement covering scope, pricing, minimum term, and royalty terms specific to that engagement. Nothing on this website amends or overrides that agreement. If there is any conflict between these terms and a signed service agreement, the signed service agreement controls. Nothing in these terms creates any agency, partnership, or joint venture relationship between you and DragonFish.

Where DragonFish sends commercial email on a client's behalf, including cold/intent email, it does so in a manner designed to comply with applicable U.S. law, including CAN-SPAM, which does not require prior opt-in for commercial email sent within the United States. Every message includes a way to opt out, and cold/intent targeting is limited to the United States. Clients remain responsible for ensuring their own use of email marketing complies with applicable law in their jurisdiction and industry.

The DragonFish name, logo, site content, and the calculator's design and code belong to DragonFish Communications, Inc. You may not copy, resell, or represent this site or its content as your own.

THIS SITE AND ITS TOOLS ARE PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ESTIMATE WILL MATCH ACTUAL RESULTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, DRAGONFISH COMMUNICATIONS, INC. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THIS SITE OR RELIANCE ON ANY ESTIMATE IT PRODUCES. IN NO EVENT SHALL DRAGONFISH'S TOTAL LIABILITY ARISING FROM YOUR USE OF THIS SITE EXCEED ONE HUNDRED DOLLARS ($100).

You agree to indemnify and hold DragonFish harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of this site or violation of these terms.

We may suspend or restrict your access to this site, including the qualify form or pricing calculator, at any time and for any reason, including suspected abuse or misuse.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of this site shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.

If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect. These terms, together with the Privacy Policy and any signed service agreement, constitute the entire agreement between you and DragonFish regarding this site. DragonFish may assign these terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver of that provision.

We may update these terms from time to time. Continued use of the site after a change means you accept the updated terms.
